Alpine Resort VACATION RENTAL AGREEMENT
Notice: This Agreement is a legally binding and enforceable document, which you should read carefully before signing.
This Vacation Rental Agreement (the Agreement) is made by and between Grandski Farms LLC (Owner) and you the (Guest) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
1. Property: The vacation rental property is located at: 7696 S Croton Hardy Drive, Newaygo, MI 49337. The property is fully furnished and includes: stove, refrigerator, microwave, coffee maker
2. Rental Party: The rental party shall consist of Guest and only the persons listed in confirmation.
3. Maximum Occupancy: An additional charge or $15 per person per night for guests in addition to agreed upon number will be assessed.
4. Rental Rules: Guest agrees to abide by the House Rules and Guidelines (attached to this agreement) at all times while at the property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while residing at the property.
7. Access: Guest shall allow Homeowner access to the property for purposes of repair, inspection or emergency. Homeowner shall exercise this right of access in a reasonable manner by giving at least 24 hours notice (unless in case of emergency). Failure to adhere to the check-out time may result in an additional late fee set at $25 per half hour unless discussed in advance of the stay.
8. Rental Rate and Fees:
A. Deposit: Security deposit will be due approximately 3 days prior to check-in in the form of a credit card hold and released approximately 5 days after check-out.
Current amounts per unit are as follows however are subject to change:
-Entire Resort: $2500
-Lodge: $1500
-Cabin 1, 2, & Suite: $1000
B. Rental Rate: Payment in full of all fees shall be due within 60 days of the Check-in Date. The deposit is for security purposes and will be refunded within 7-10 business days of the Check-out Date, provided no deductions are made due to: i. damage caused to the property or furnishings; ii. dirt or other mess requiring excessive cleaning; or iii. any other cost incurred by Homeowner due to Guest’s stay The deposit is non-refundable and applied toward the rental fees. If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.
9. Cancelation Policy: If Guest wishes to cancel the reservation, the deposit will be refunded as follows for single unit bookings: 50% if canceled 30 days prior to the Check-in Date 100 % if canceled 60 days prior to the Check-in Date. For resort bookings: 50% refund will be issued if canceled 60 days prior to the Check-in Date. All refunds will be less the 3% payment processing fees. The Homeowner may also be entitled to cancel the Guest stay if house rules are broken during rental period.
10. Insurance: We encourage all renters to purchase traveler insurance in case of unforeseen circumstances, accidents or other issues that may prohibit Guest from traveling or fulfilling rental terms. Owner shall not be liable for any damage or injury occurring on or about the Premises to Guest, Guest's family members, guests or invitees, except in the case of Owner's failure to perform, or negligent performance of, a duty imposed by law. Guest hereby agrees to protect, indemnify and hold Owner harmless from and against any and all losses, costs, expenses, damages, or liability arising out of any accident or other occurrence on the Premises or any part thereof, or in any common area, causing injury to any person or property whomsoever or whatsoever, no matter how caused, except in the case of Owner's failure to perform, or negligent performance of, a duty imposed by law. Owner is not responsible for damage to Guest's personal property resulting from fire, storm, rain, flood, power outage, appliance failure, theft, vandalism, leaking fixtures, acts of God, etc. Guest accepts responsibility for insuring their personal property. Guest shall also be liable to Owner or its insurance carrier for any damage to the premises or to the Owner's other property, such as other rental units, common facilities and equipment that is caused by the acts or omissions of Guest or Guest's guests.
11. Lead-based Paint Disclosure. (Housing constructed before 1978 only.) Guest acknowledges the home was built prior to 1978 and the unit could contain lead based paint although it is not immediately likely due to remodeling.
12. Covenants and Conditions. Each provision of this Agreement to be performed by Guest shall be deemed both a covenant and a condition which Guest agrees to abide by strictly. Any violation of any provision of this Agreement shall constitute a material breach of same, in which case Owner may, at option, terminate this Agreement according to its terms. In the event of such termination, Owner agrees to use their best effort to re-rent the Premises or to otherwise mitigate damages as required by law.
13. Binding Effect. The covenants, conditions, and agreements contained in this Agreement shall bind and inure to the benefit of the Owner and the Guest and their respective heirs, distributees, executors, administrators, successors, and assigns.
14. No Waiver. Owner's failure to enforce any term of this Agreement shall not be deemed a waiver of the enforcement of that or any other term. The receipt by Owner of rent with knowledge of a breach of any term of this Agreement shall not be deemed a waiver of such breach, nor shall partial payment of rent be deemed a waiver of Owner's right to the full amount thereof.
15. Severability. If any provision of this Agreement should be or become invalid, such invalidity shall not in any way affect any of the other provisions of this Agreement, which shall continue to remain in full force and effect.
16. Subordination. The Agreement is and shall be subject and subordinate to any ground or underlying agreement or lease and mortgages now or hereafter affecting the real estate of which the Premises are a part, and to all renewals, modifications, replacements, and extensions thereof.
17. Entire Agreement. Guest acknowledges that Owner has made no representations or promises with respect to the Premises except as herein expressly set forth and that the foregoing constitutes the entire Agreement between the parties.
18. Payment: Acceptable payment methods are: credit card/PayPal/bank transfer all payments, unless otherwise specified, will be processed on our vacation rental website at the URL: www.alpineresort.staydirectly.com



House Rules and Guidelines
Our aim is to ensure that you have as comfortable a stay as you possibly can. We love helping facilitate a 5-star guest experience! If during your stay, anything bothers you, contact us, we want to know so we can do our best to make it right. We will always be available by text or phone (231-846-8088 or 616-510-9934). Call twice between hours of 10pm-630am. PLEASE TAKE CARE TO READ ALL THE RULES BELOW IN THEIR ENTIRETY.
PARKING:
When you arrive at Alpine Resort you will have 2-3 parking spaces available for you to use. If you require more spaces please reach out to us. All parking spaces are located along the side of the suite. DO NOT PARK ON THE GRASS OR ALONG THE MAIN DRIVE AS THIS COULD BLOCK OTHERS!
ACCESS:
-Check in is 4pm-10pm, check out is 11am. If you plan to arrive outside of the check-in window you must reach out to us.
-If you'd like to check-in early or check-out late there please reach out to the host. There is generally a small fee for these requests.
-The door has a key code. Code will be sent 1 hour prior to check-in. If you have any problems with access do not hesitate to call us immediately there is a lock box with a copy of a key on-site.
KITCHEN:
-Help yourself to anything in the kitchen. We supply coffee, as well as cooking utensils should you wish to cook. IF something runs out or doesn't work please leave it empty on the counter or send us a message so we can ensure it is replenished/fixed.
-KINDLY start dishwasher/clean dishes prior to leaving and if time allows return them to cabinets in -same location as found.
-KINDLY dispose of used food and containers from refrigerator and cabinets.
-Refrigerator, microwave, stove, coffee pot should not be left excessively dirty.
-KINDLY take trash out to blue dumpster prior to departure.
BEDROOMS/LIVING AREAS:
-We kindly ask that you leave the place as you would leave yours.
-Our preference is that you remove your shoes at the door to avoid excess dirt and debris in the unit.
-We reserve the right for additional cleaning charges due to cleaning related to bio-hazard/bodily fluid spills/damages.
-We do recommend travel insurance to cover damages or trip cancellations.
-No video or other marketing production without consent of owner.


BATHROOMS:
-Toilet paper ONLY in toilets to avoid additional charges.
-If you forgot something, we’ve got most of the essentials covered! Please do not abuse this complementary service and only use if you are in need.
-Please leave used towels/linens on floor.
HEATING/COOLING:
-Feel free to set the systems to your desired comfort level however please be courteous not to abuse the systems by setting extremely low or high.
-KINDLY turn down heat and turn off AC prior checkout.
OUTSIDE/COMMON AREAS:

-Respect quiet hours 9pm-8am

-This property is shared by up to 4 groups at a time please respect the private areas of each space by not walking through or using these areas (mainly suite and lodge waterfront patios/fire pits/cabin 2 patio). Reference map for boundaries.

-Feel free to use the private docks and lake to swim in however respectfully avoid using any of the waterfront patio areas which are exclusive to the guests in those units.

-Firepit is available exclusively for your use and is to be used responsibly and AT YOUR OWN RISK. We assume no responsibility for injuries or damages caused by having a campfire.

-Fires are to stay within the fire enclosure/ring and flame should not exceed approximately 2 feet in height. -Fire wood can be provided at an additional charge of $5 per bundle

-KINDLY close all windows so smoke does not enter cabin

-Grill on patio is available for use or shared use depending on location. Propane MUST be turned off after use to avoid draining the tank when not in use. DO NOT MOVE THE GRILL.

-One dock spot is available for your use, docks are labeled. If you require more dock space please let us know. (seasonal approx Apr 1-Oct 15)
-Four kayaks, bikes, and other items are available for shared use with other guests staying on the property. Please be courteous with your use to ensure each party has an ample opportunity to enjoy. All common area equipment is to be used at your own risk, host assumes no responsibility for their use and makes no claims on their condition. If the equipment is in disrepair you should let us know immediately and not utilize it until it is in proper working condition.
-Kayaks should be drained and returned to their storage location when complete. Life jackets should be hung to dry in similar location.


-Double wrap fish waste in airtight plastic bags to minimize smells

-Fish cleaning table near boat dock, DO NOT clean fish inside a building

-No smoking within 50 feet of buildings or inside buildings, butts must be disposed of properly NOT ON GROUND! You will be charged for cleaning if smoking is done inside any building.

-NO PETS ARE ALLOWED WITHOUT DOCUMENTATION OF SERVICE ANIMAL CERTIFICATE. You will be charged a minimum $150 cleaning fee and for any damages done by pet during stay. Please note we do allow pets in cabin 1 and 2 for an additional fee of $15/per pet per night upto 2 pets max. Please be aware that you will be charged a minimum $150 cleaning fee for excessive messes and for any damages done by pet during stay. The pet fee does cover the extra time it takes to clean after a pet stay. Excess cleaning includes but is not limited to; excess pet hair on furniture/linens/blankets from pets being allowed on these items, any chewed/scratched items, excess hair in non standard areas, dog waste left in lawn, etc

-SMOKING IS ALLOWED BY THE CAMPFIRE IF NOT OFFENDING NON-SMOKERS

-The property is equipped with video surveillance for your safety and safety of others.

GUESTS:
-No overnight guests without permission and $15/person fee.
-Tenant must supervise and accepts full responsibility of all guests during their stay.
-Guests must obey all rules of the property.
Any breach of above house rules could result in additional fees/charges. By accepting/submitting payment for this reservation I agree to obey and follow these house rules and guidelines and if not I understand that the owner has a right to proceed with additional action either through fees, removal from property, or legal action.
By submitting my personal information and card information for payment, I hereby give permission to charge my credit card/PayPal account for the amounts on invoice. I agree that all rental monies are non-refundable per cancellation policy above. I have read my rights to purchase travel insurance. Also, indicates the Guest has read, understands, is satisfied with, and agrees to abide by all conditions of this agreement. The invalidation of any provision herein by Judgment of Court order shall not otherwise affect any of the other provisions of this agreement.
